Gift Certificates and Referrals to Agents

However, if an agent distributes a Gift Certificate to an active client that uses the Home Efficiency Checkup information to impact a ‘closing’ settlement or any form of buy/sell transaction, then the agent is prohibited from receiving a referral per the Real Estate Settlement Procedures Act (RESPA).
The New RESPA regulations were published on November 17, 2008 and are scheduled to take full effect on January 1, 2010. Under RESPA, referrals on Home Inspections are still prohibited while referrals for Home Efficiency Checkups or ‘Energy Audits’ are deemed acceptable as long as they are not executed in connection with closing. Top legal council from major organizations and associations has corroborated this difference, but each agent and broker should weight the situation and accept referrals ONLY for past clients that seek to reduce their energy consumption and save money on their utility bills. Simply, the Real Estate Settlement Procedures Act was not designed to restrict agents from assisting homeowners in reaching energy efficiency but more to ensure objective representation at the time of settlement.
Many real estate agents over the years have developed a significant list of past clients that are not necessarily looking to sell their homes in this difficult economic climate, so this referral program rewards the agents that want to help drive American Energy Independence. The referral is typically $50 per Home Efficiency Checkup. With hundreds of past clients, agents can generate referrals that add up to several thousand dollars, which are naturally subject to income tax, accordingly.
